Welcome to Printable Scenery.

Printable Scenery Limited (“Printable Scenery”, “we”, “us” or “our”) is a New Zealand company, company number 8028843, providing digital 3D-printable STL files and related products for tabletop wargaming, role-playing games and modelling.

These Terms and Conditions govern your use of:

www.printablescenery.com (the “Site”);
our services;
STL files and other digital products supplied through the Site; and
any licence granted to you to use those products.

Please read these Terms carefully.

1. Agreement to These Terms

By accessing or using the Site, creating an account, purchasing a product, downloading an STL file or otherwise using our services, you agree to be bound by these Terms and Conditions.

These Terms form a binding agreement between you and Printable Scenery Limited in relation to your use of the Site, our products and any licence granted by Printable Scenery.

If you do not agree to these Terms, you must not use the Site or our products.

2. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will publish the updated version on the Site and update the “Last updated” date.

Updated Terms will apply to future use of the Site and future purchases.

Unless required by law or expressly agreed otherwise, changes to these Terms will not retrospectively alter the licence applying to an STL file that you validly purchased before the change.

3. Changes to the Site and Services

We may modify, update, suspend or discontinue features of the Site or our services from time to time.

We may also update STL files, replace files, correct errors or make improvements to our products.

Where reasonably practicable, existing customers will continue to have access to STL files they have validly purchased, subject to these Terms and any circumstances outside our reasonable control.

Nothing in this section limits any rights you may have under applicable consumer law.

4. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

Our Site may also use cookies and similar technologies in accordance with our Privacy Policy and Cookie Policy.

5. Site Licence

We grant you a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the Site for lawful personal purposes.

This licence does not give you any ownership interest in the Site or its contents.

6. STL Licence

When you validly purchase an STL file or other licensed digital product made available by Printable Scenery, Printable Scenery grants you a:

non-exclusive;
non-transferable;
non-sublicensable; and
perpetual,

licence to use the relevant STL files for your personal, non-commercial 3D printing and to use the resulting physical printed models for your personal, non-commercial use.

This is referred to in these Terms as the STL Licence.

No STL Licence is granted until payment for the relevant product has been successfully completed and the product has been supplied to you through Printable Scenery or our authorised reseller.

The purchase of an STL file does not transfer ownership of the STL file, design, artwork, model or associated intellectual property to you.

7. Commercial Use

The standard STL Licence does not permit commercial use.

You must not manufacture, sell or otherwise commercially exploit physical prints produced from Printable Scenery STL files unless you have a current commercial licence or Licensed Printer Agreement issued or authorised by Printable Scenery.

Commercial licences are separate agreements and may contain additional terms, fees and restrictions.

8. Restrictions on Use

Unless we have given you express written permission or you hold an applicable commercial licence, you must not:

use our STL files for commercial purposes;
sell, rent, licence, sublicense, assign, distribute or transfer STL files;
share STL files with another person or business;
upload STL files to file-sharing services, cloud libraries, torrents, marketplaces or other distribution services;
provide STL files to another person to print for their own use;
modify, remix or create derivative STL products for distribution or sale;
reproduce or redistribute our digital files;
reverse engineer, decompile or disassemble our files or Site;
use our files or Site to create a competing digital product library or service;
remove copyright, trademark or proprietary notices;
falsely represent yourself as an authorised Printable Scenery retailer or Licensed Printer; or
use our intellectual property in a manner not expressly permitted by these Terms.

You may make reasonable backup copies of files you have validly purchased solely for your own personal use.

9. Intellectual Property

All intellectual property rights relating to the Site and our products, including:

STL files;
3D models;
designs;
artwork;
illustrations;
photographs;
graphics;
written content;
trademarks;
logos;
product names;
systems and components; and
website materials,

are owned by Printable Scenery, our licensors or the applicable rights holder.

Except for the limited licences expressly granted in these Terms, no intellectual property rights are transferred to you.

All rights not expressly granted are reserved.

10. Paddle and the Order Process

Our order process is conducted by our online reseller Paddle.com.

Paddle.com is the Merchant of Record for all orders processed through Paddle. Paddle provides customer service for payment-related enquiries and handles returns and refunds for those transactions.

When you purchase a Printable Scenery product using Paddle Checkout, the purchase transaction is between you and the applicable Paddle entity acting as Merchant of Record.

Printable Scenery remains the creator, supplier and licensor of the relevant digital products and grants you the applicable STL Licence under these Terms.

Paddle is responsible for transaction-related functions including:

processing payment;
payment security;
billing;
applicable transaction taxes;
invoices and receipts;
payment-related fraud prevention;
chargebacks; and
payment and refund processing.

11. Prices and Payment

You agree to pay the price displayed at checkout before completing your purchase.

The total amount payable, including applicable transaction taxes where relevant, will be displayed through the Paddle checkout before you confirm the transaction.

Available payment methods will be displayed at checkout.

Printable Scenery does not receive or store full credit or debit card details for transactions processed through Paddle.

You must not make, or attempt to make, a payment using:

fraudulent information;
an unauthorised payment method;
stolen payment credentials; or
any unlawful method.

You must be authorised to use the payment method you select.

12. Taxes

For transactions processed through Paddle, Paddle acts as Merchant of Record and generally calculates, collects and remits applicable transaction taxes, including GST, VAT and sales taxes, where required.

Any tax treatment applicable specifically to you outside the transaction remains your responsibility.

13. Order Acceptance and Fulfilment

An order is not complete until payment has been successfully processed.

Once a purchase has been successfully completed, we will make the purchased digital product available through your Printable Scenery account, download system or another method described at the time of purchase.

We may refuse, suspend or cancel fulfilment where we reasonably believe that:

a transaction is fraudulent;
a payment has been reversed;
an obvious pricing or technical error has occurred;
an order breaches these Terms; or
we are required to do so by law.

Nothing in this clause limits non-excludable consumer rights.

14. Refunds

Because STL files and other products supplied by Printable Scenery are digital goods that can normally be accessed shortly after purchase, we are generally not required to provide a refund merely because you change your mind, except where applicable law gives you that right.

However, Printable Scenery may approve a change-of-mind refund at our discretion where:

you have not downloaded or accessed the relevant files; and
you request the refund within seven days of purchase.

For transactions processed by Paddle, approved refunds are processed through Paddle as Merchant of Record.

Payment, billing and refund enquiries may also be made through Paddle’s buyer-support service.

Where a product is faulty, materially different from its description or you otherwise have a right to a refund or remedy under applicable consumer law, those statutory rights are not affected by these Terms.

15. Chargebacks and Reversed Payments

If a purchase is refunded, reversed, charged back, cancelled, found to be fraudulent or otherwise invalidated, we may suspend or terminate your access to the affected files and any licence relating to that purchase.

Initiating a dishonest or fraudulent chargeback may also result in suspension or termination of your Printable Scenery account.

Nothing in this section prevents you from exercising legitimate legal or consumer rights.

16. Product Compatibility and 3D Printing

We make reasonable efforts to provide accurate product descriptions and usable STL files.

However, successful 3D printing depends on many factors outside our control, including:

printer model;
calibration;
filament or resin;
slicer software;
software versions;
printer settings;
support settings;
environmental conditions; and
user experience.

We may provide recommended printer or slicer settings, but unless required by law, we do not guarantee that every product will print successfully on every possible printer or configuration.

If you experience difficulty opening or printing a file, please contact us so that we can attempt to assist.

17. Consumer Rights

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.

This includes applicable rights under the New Zealand Consumer Guarantees Act 1993, where that Act applies, and any mandatory consumer rights applicable to customers in other jurisdictions.

To the extent that a guarantee, condition, warranty or remedy cannot legally be excluded, these Terms are subject to that right or remedy.

18. Warranties

To the maximum extent permitted by law, we do not provide warranties or guarantees other than those expressly stated in these Terms or required by law.

We do not warrant that:

the Site will always be available;
the Site will be free from errors;
every STL file will be compatible with every printer or software configuration; or
every feature of the Site will remain available indefinitely.

19. Limitation of Liability

Nothing in this section limits liability that cannot legally be limited.

To the maximum extent permitted by law, Printable Scenery will not be liable for indirect, consequential or special loss arising from your use of the Site or products, including:

loss of profits;
loss of business opportunity;
loss of anticipated savings;
loss or corruption of data; or
consequential economic loss.

Where liability may lawfully be limited, Printable Scenery’s aggregate liability relating to a particular purchase will not exceed the amount paid for the relevant product.

Any liability will also be reduced to the extent that your acts or omissions contributed to the loss.

20. Account Security

You are responsible for maintaining the confidentiality of your Printable Scenery account credentials.

You must not permit another person to use your account to access or download products they have not validly purchased.

You should contact us promptly if you believe:

your account has been compromised;
someone has accessed your files without permission; or
your account credentials have been disclosed.

21. Suspension and Termination

We may suspend or terminate access to an account where we reasonably believe the user has:

materially breached these Terms;
unlawfully distributed our files;
infringed our intellectual property;
engaged in fraud;
circumvented our licensing controls;
abused our Site or services; or
otherwise engaged in unlawful activity.

Termination of an account does not prevent us from taking other action available under law.

Where reasonably appropriate, we may give you an opportunity to remedy a breach before termination.

22. Marketing Communications

Where permitted by law, we may send you marketing communications if you have subscribed, opted in or otherwise lawfully agreed to receive them.

You may unsubscribe at any time using the unsubscribe link contained in our marketing emails.

Service communications relating to purchases, accounts, licence changes or security may still be sent where necessary.

23. Disputes

If you have a complaint or dispute concerning Printable Scenery, our products or your STL Licence, we ask that you contact us first so that we have an opportunity to resolve the matter.

Payment, billing, transaction and refund enquiries relating to Paddle transactions may also be directed to Paddle.

Nothing in this clause prevents either party from exercising any legal right, seeking urgent relief or using a consumer dispute-resolution process available under applicable law.

24. Governing Law

These Terms are governed by the laws of New Zealand.

Subject to any mandatory consumer rights that apply in your jurisdiction, the parties submit to the jurisdiction of the New Zealand courts.

Nothing in this clause removes any mandatory right a consumer may have to bring proceedings or pursue a remedy in another jurisdiction where applicable law provides that right.

25. Severability

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be modified or severed to the minimum extent necessary.

The remaining provisions will continue in full force.

26. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights or obligations where reasonably required as part of a restructuring, sale, transfer of business or similar transaction, subject to applicable law.

27. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

A waiver relating to one breach does not constitute a waiver of any subsequent breach.

28. Force Majeure

To the extent permitted by law, we will not be liable for delay or failure caused by circumstances beyond our reasonable control, including:

internet or hosting outages;
denial-of-service attacks;
natural disasters;
major equipment or infrastructure failure;
governmental action;
war or civil disturbance;
third-party service outages; or
other events outside our reasonable control.

These Terms should be read together with our:

Privacy Policy;
Refund Policy, where separately published; and
any specific licence or commercial agreement applicable to a product or service.

If a separately signed commercial licence or Licensed Printer Agreement conflicts with these general Terms, the specific commercial agreement will take precedence in relation to the matters it covers.
